Agreement/jurisdiction

Upon booking, Darcy Bly, known as "Photographer", shall provide services to photograph a photo session to the best of her abilities, in the manner indicated. These terms and conditions incorporate that payment of the deposit fee, the date as agreed upon will be retained on the calendar and held in its entirety for the client.

Payment

Client shall reserve the time and date of services with a non-refundable, non-transferable reservation retainer equal to 50% of the total photography fee. The balance due for the photography services will be paid in full on the day of the session.

Cancellation

If for any reason the session is canceled, the full amount of the deposit is non-refundable.

Reschedule

In the event that Client reschedules the session date and Photographer is able to rebook the original session date, Client will receive credit for all the monies already paid. The new package price will reflect pricing in effect when the date change occurs. In the event that Client reschedules the session and Photographer is not able to rebook the original session date, Client forfeits the retainer but will receive a credit for all other monies paid.

Liability

If the photographer is unable to perform any or all the duties herein for any reason, an associate shooter will be sent to cover the client date.

Trravel fees

Travel within 2 hrs. of Corryong, Victoria is completely free of charge. A Mileage fee($2/mile both ways) will be charged for locations outside of the 80-km radius outside of Corryong, Victoria.

Image archive

All images will be available for download for up to 2 years following the session date. Client is responsible for downloading their images in a timely manner. The Photographer cannot guarantee the images will be kept beyond a 2 year period.

Copyright

The Photographer shall own the copyright on all the images created and shall have the exclusive right to make reproductions for, including but not limited to, marketing materials, portfolio entries, sample products, promoting sessions, editorial submissions and use, for display within or on the Photographer's website and / or studio.
